In a recent legal development, Charlie Sheen is set to secure full custody of his 14-year-old twins, Bob and Max, if his ex-wife Brooke Mueller fails a drug test.
Court documents obtained by Page Six reveal that the Two and a Half Men star was granted an emergency request, allowing him to assume sole legal custody in the event of a positive drug or alcohol test for Mueller.
The court order stipulates that Mueller must undergo drug and alcohol testing as frequently as required by her probation officer, within 24 hours of a written request from Sheen or his attorney, and at least once per week.
Any positive test will result in the immediate termination of Mueller's custody and visitation rights. Additionally, she is required to provide the names, addresses, and phone numbers of her regular sources of controlled substances to Sheen's attorney.
While both Sheen and Mueller have grappled with addiction in the past, Sheen recently celebrated six years of sobriety. Although the court documents do not specify the reasons for requesting modifications, they indicate that Sheen and Mueller had previously agreed to the stipulations in November 2022 and August 2023. Sheen's expart motion was granted without his ex-wife's response.
The child custody modification was signed in August 2023, just one month after Mueller's relapse and engagement in substance abuse. Although Sheen has not publicly addressed the legal filing, he previously mentioned being a single dad, actively involved in raising his sons, while Mueller worked through her challenges. Sheen emphasized that Mueller was not actively present in the picture during this period.
Mueller's struggles with addiction were made public, and she reportedly sought help through a 12-step program. Sources indicated that the program appeared to be beneficial for her. The couple, who tied the knot in 2008, had faced challenges, leading to Sheen filing for divorce in 2010. As the legal proceedings unfold, Sheen remains dedicated to providing a stable environment for his teenage sons amidst their mother's ongoing struggles.
